David Goldman and his Brazilian attorney Ricardo Zamariola are today filing an emergency appeal with the Brazilian Supreme Court to negate the stay order issued by Justice Marco Aurelius Mello. It is hoped that the Supreme Court will hear the appeal today, if not the court goes into its Christmas recess, not returning until February 2010.

Reacting to the events in Brazil on Thursday, Senator Frank Lautenberg of New Jersey placed on hold a trade bill now in the U.S. Senate that would benefit Brazil and other countries exporting some products duty-free to the United States.

BREAKING NEWS – Thursday 17 December 2009
Brazilian Supreme Court justice Marco Aurelius issued a stay order on the return of Sean Goldman until February 2010 when the justice returns from recess. The stay order permits his review a writ of Habeas Corpus filed by Silvana Rebiero, Sean’s maternal grandmother who is not a party to this Hague Treaty case. In his statement to the news media the justice was reported stating that the case should be reviewed in accordance with UN Convention on the Rights of the Child. If that is permitted then the Hague Treaty on the Civil Aspects of Child Abduction is effectively repudiated by the Brazilian judiciary.

At this time both David Goldman and U.S. Congressman Christopher Smith remain in Brazil. We also do not know if David will be allowed to visit Sean while he is in the country.

BREAKING NEWS – Wednesday 16 December 2009 @ 19:00 GMT – 2:00 PM EST
The Brazilian Federal Regional Tribunal (TRF-2) today issued a unanimous ruling upholding the return order of Sean Goldman by Friday December 18th. Although it can be expected that the Lins e Silva and Rebiero families will file additional appeals directed at Brazilian Supreme Court Justice Marco Aurelius to stay the return order, David Goldman departed tonight for Brazil, accompanied by United States Congressman Christopher Smith (R-4) of New Jersey.

David stated today: “I’m hopeful, I can’t be optimistic because I’ve gone down there so many times, always under the guise that the rule of law will be followed and Sean will come home to me and his family, and that doesn’t happen.

Mark DeAngelis, the head of the Bring Sean Home Foundation, stated this afternoon that we will remain “cautiously optimistic” until David and Sean are on an airplane home and “the wheels are up.” The Lins e Silva and Rebeiros have filed +40 delaying appeals since the initial ruling this past June.

Without your dedication in sending emails, writing letters, making phone calls, attending the rallies, we wouldn’t be having our Congressmen, Senators, Secretary of State and President aware of the injustice happening to David. It is a worldwide issue and we hope the international community will be inspired by all you are doing and take action not only for David but others in his situation. The United States House of Representatives voted on March 11, 2009 to approve House Resolution 125 calling on Brazil to fulfill its treaty obligations under the Hague Convention and immediately return Sean Goldman to his father in the United States. The vote was Unanimous!

New Rally Date: Saturday March 14 @2:00pm

The date of Brazilian President Lula’s meeting with President Obama has been changed to Saturday March 14th. The protest rally will be from 2:00 to 5:00 to correspond with the 4pm meeting between Presidents Obama & Lula. The bus will leave NJ at 9:30am and we expect to be back to the parking lot at approximately 9-10pm, depending on departure time and traffic.

We have one week to produce as large a turnout as possible. We need all of you to reach out to people you know in the DC area, old college friends, relatives, work colleagues, etc and encourage them to join us. Let’s get to work on this and make this rally a huge success.

We will be lining up speakers for the rally next week and hope to announce the speaker list toward the end of the week. The media will be there in numbers so a good crowd is important. Again, our sincere apologies for the late date change, which was beyond our control.

Due to circumstances beyond our control, we may have to move the date of the planned rally in Washington DC. We thought we had a confirmed date of March 17 for the meeting between Presidents Obama and Lula, but it looks like that meeting date will change. Apparently, the issue is the fact that March 17 is St. Patrick’s Day and that there is a lot of activity in DC going on so it is less than ideal for Obama to host Lula that day.

As for the new date, it looks like it may be either Saturday March 14 or Wednesday March 18. We are very hopeful we’ll have the date nailed down in a couple of days, so stay tuned.

And our sincere apologies to all of you who have made travel plans to join us in DC. We really hope you can still join us and we promise to post the new date just as soon as we can confirm it.

 

The Today Show on NBC will air an update on the Sean Goldman abduction case at approximately 7:15 a.m. Eastern, Wednesday, March 4, 2009. The update will include clips from an interview with United States Secretary of State Hillary Clinton commenting on the case. NBC News Chief Foreign Affairs Correspondent, Andrea Mitchell, conducted the interview.

David Goldman will also be in the Larry King Live studios in Los Angeles for a live interview Wednesday night, March 4th. Other guests working on the case may appear as well. The Larry King Live show is broadcast worldwide by CNN at 9:00 p.m. Eastern (23:00 Brasil ES/DF/GO/MG/RJ/SP).

House Resolution 125 Update

The listing of cosponsors for H. RES 125 is updated as of 5:30pm today. I’ve added two tables to the H. RES 125 page which lists the names of the members of the House Committee on Foreign Affairs, highlighting those who have not yet become cosponsors.

There is a separate table listing of the 13 members of the NJ Congressional delegation. It is sadly reproduced below. Officially, we know they are very busy with the stimulus package. Unofficially, I’m speechless or prefer to say… “%$#@*&^%????

It was also reported today that O Globo newspaper picked up the story of David Goldman’s custody battle with the Lins e Silva’s that ran in the NY Times (copy here on BSH). Unfortunately I kept getting server timeouts when I tried to connect to the O Globo server. Now it appears that the pages have been taken off line. The Subscriber database for this Blog cannot be imported into the Forums. If you are a registered Subscriber for this Blog and want to post in the Forums you will have to register a Username, password and valid email address.

The Forums are fully operational but will be undergoing “cosmetic” modifications so don’t be alarmed if it looks different from one day to the next.

News Update Feb 16

David arrived home from Brazil last Thursday (Feb 12) and immediately hopped on an Amtrak train for the three-hour trip to Washington DC. David met with Congressman Chris Smith and other high level officials in the US government. David also had a meeting with Brazilian Ambassador Antonio Patriota. The important take-away from the meeting with the Ambassador was a reassurance that the Brazilian Government wants to do the right thing, follow their treaty obligations, and reunite Sean and David on US soil. The Ambassador pointed out that the Brazilian federal government has filed the amended Hague application for the immediate return of Sean to David in the US and cited this as evidence of the Brazilian Government’s cooperation in this case.

It was also very important for David to finally have his voice heard in Brazil. Brazilian Superior Court Judge Luis Felipe Salomão (as stated on his own web page at http://www.stj.gov.br/portal_stj/publicacao/engine.wsp?tmp.area=398&tmp.texto=90842) pushed for David and Sean to reunite, emphasizing the extreme and urgent importance for father and son to begin to re-bond after 4.5 years of separation. Judge Salomão stressed the importance for the biological father and son to be together.

Sean and David were able to be together for visits on consecutive days last week. Their bond was not broken! Their unconditional love for each other still lives strong! And Sean still speaks English, despite what some in Brazil would have you believe. It was extremely difficult for David and Sean to say goodbye to each other at the end of the visitation. Father and son need to be permanently reunited in order to end this completely unnecessary suffering. David wanted to remain in Brazil and take his son to school to see Sean’s teachers, but was not permitted to do so.

David is hoping, if he must travel back to Brazil for only another “visit” with his son, that he will at least be allowed to have some liberty with Sean to take him for ice cream or buy him a toy and do some very simple, basic, natural things a father and son should be able to do together, something that was not permitted during this round of visitation. However, given the nature of the situation and the behavior of the people retaining Sean, David does not have high hopes that this will be easily obtained.

What about the legal case and where do we go from here? The case records will be sent to the federal courts sometime next week. We will then wait for the federal decision on the Hague Convention case, which must reunite Sean and David on a permanent basis, expeditiously, in New Jersey. All of you are making a difference, this cannot be emphasized enough. PLEASE, keep doing what you’re doing, your support is tremendous. So much good has happened in a short while, the momentum is with us. Let’s keep it going.

We are also planning a demonstration in Washington DC on Tuesday March 17 at Lafayette Park, across from the White House, to coincide with President Lula’s meeting with President Obama. We fully expect the topic of the Sean Goldman abduction case to be on the agenda for that meeting.
