A 14-year-old Bermudian child allegedly abducted by his mother in 2003 was found in Florida yesterday [Feb.2], according to US media and police reports.
 
The child’s mother – 40-year-old Bermudian Kim Sakena Swan [pictured]  – was arrested and charged with interference with child custody.
 
The child is expected to be reunited with his father — Bermudian Giovanni Burrows who lives in Bermuda, and works as a ferry pilot for Marine & Ports.
 
Bermuda’s legal system had placed the child in the care and custody of Mr. Burrows in 2002.
 
In January 2003 — when he was five years old — his mother took him to the United States and Mr. Burrows was unable to find him for many years, despite a relentless effort to find his son.
 
The child has been listed as missing by Interpol for a number of years, and was also listed by the US National Center for Missing & Exploited Children [NCMEC].
 
After many years of searching for his son, Mr. Burrows was overjoyed to be reunited with his son in Florida last year, however while in court his mother is alleged to have abducted him again.
 
Mr Burrows was scheduled to get custody of the child at a hearing at the Pinellas County Courthouse in Florida. At the courthouse, the boy said he had to go to the bathroom and that’s when he secretly met his mother and the two took off.
 
Ms Swan remained on ‘the run’ with the child, until being caught by American law enforcement earlier this week. She has a second child, a daughter. This second child is believed to about eight or nine years old and believed to be fathered by an American.
 
Both children are said to be in the care of the American child protective services, and Ms Swan remains in a Jacksonville jail on $29,000 bond. She was also accused of petty theft, and a screenshot from the Jacksonville jail website showing the charges she was arrested on yesterday can be seen here.
 
Mr. Burrows is expected to head to Florida today or tomorrow to be reunited with his son, and start the process of bringing him home to Bermuda.

An emergency hearing regarding the future of a Bermudian teenager was cancelled yesterday, leaving a father in limbo.

Jasai Swan-Burrows was five-years-old when his mother, Kim Swan, left the Island with temporary custody of the boy.

Since then, his father Giovanni Burrows has spent years trying to track down his son. That search ended on Thursday when police in Jacksonville arrested Ms Swan for interference with child custody.

Since the saga began, Ms Swan had a second child, a daughter fathered by a Bermudian.

Yesterday Mr Burrows was in the north Florida city to attend an emergency hearing, hoping to bring 14-year-old Jasai back to Bermuda, but that hearing was cancelled.

Family friend Sonja Baptiste said: “They found Kim Swan in Jacksonville with the children. That was on February 2 in the afternoon, and as far as Jasai and his little sister, they were transferred to foster care.

“Mr Burrows got to Jacksonville late (Sunday) night for the hearing. He didn't even have enough money to get a hotel room. This search has left him strapped.

“Giovanni spoke to Jasai. He said it seems Jasai is not happy with having to leave the United States, but he's optimistic that his little sister will be coming along soon after.

“We understand that there are relatives in Bermuda who are interested in taking her in, but she is American, so it will be much harder.”

In the meanwhile, she said Mr Burrows is remaining in Jacksonville to fight for custody of his son as he can no longer afford a lawyer to represent him.

Over the past nine years, she said Mr Burrows has spent a huge sum trying to find his son and bring him back to Bermuda. Several times they felt that the search was over, only to have hope torn from their grasp.

Mr Burrows had previously travelled to Clearwater, Florida to pick up his son.

A caretaker took the teenager to the Clearwater Main Library to await the end of the hearing art the county courthouse, but the boy told the caretaker he had to go to the bathroom and instead met with his mother.

Prior to Thursday's arrest, Mrs Baptiste said they knew police were close, but had to remain tight lipped.

“The time before last she was tipped off before they got there,” Mrs Baptise said. “They found an empty house with children's toys still there.”

Even yesterday, Mrs Baptise said she was concerned the painful story wasn't over.

“I'm in disbelief. After all that has happened, I feel like I have drawn a line in the sand. When I can see him and tough him I will believe it,” she said. “That's when this will be over.

“Until then, I'm not going to get my hopes up.”

Bermudian Giovanni Burrows, who had been searching for his son Jasai Swan-Burrows for nine years, was finally reunited with him earlier this week — only to have the boy disappear again.
 
According to a friend of Mr. Burrows, US authorities removed Jasai from the custody of his mother, Kim Sakena Swan, and placed him in Mr. Burrows’s care.
 
However he disappeared again just prior to a scheduled court appearance for a formal decision by US authorities on final custody.
 
In January 2003 — when Jasai was five years old — his mother took him to the United States and Mr. Burrows had not seen him since, although he has been relentless in his efforts to find his son.
 
According to Ms Sonja Oliveria who has been involved with Jasai’s recovery, Bermuda’s legal system had placed Jasai in the care and custody of Mr. Burrows in 2002. Ms Swan removed Jasai from Bermuda in January 2003 when she had temporary custody of her son.
 
Ms Oliveira said it appears that Ms Swan had a second child, a daughter. She said this second child, Jasai’s half-sister, would now be about eight years old and was believed to be fathered by an American.
 
Ms Oliveira said information received during the almost decade-long search for Jasai had led Mr. Burrows’ supporters to believe Ms Swan may have had several brushes with US law enforcement. She said searches showed that Ms Swan had been listed as either having no known address or as living in shelters for the homeless.
 
A quick online search for the mother’s name leads to a page showing a mugshot and an arrest record for theft. The arrest record is from March, 2011, and shows her address as “transient” within the St. Petersburg Florida area. Additional data shows she was also arrested in 2010 in the same area.
 
Jasai has been listed as missing by Interpol for a number of years. He was also listed by the US National Center for Missing & Exploited Children [NCMEC], with their site saying, “Jasai may be in the company of his mother. They are believed to be in Jacksonville, FL.”
 
“He may use the alias last name Butterfield. Jasai’s father has applied for the return of the child to Bermuda under the international civil treaty: The Hague Convention on the Civil Aspects of International Child Abduction.” Yesterday the listing was removed, however still can be seen through the cache system.
 
After nine years of searching for his son, Mr. Burrows was overjoyed to be reunited with Jasai in Florida earlier this week [pictured above]. Bernews had spoken with Mr. Burrows yesterday to obtain to permission to run the story about his son being found. But before we were able to report it, Jasai disappeared again.
 
The support group formed on Facebook said, “Jasai’s mother is wanted by Bermuda and US authorities for unlawfully removing Jasai from his father’s custody (and is under investigation for assaulting Jasai’s father). Jasai was located and reunited with his father on May 5, 2011, but while in court to legally transfer Jasai back to Bermuda, his mother abducted him again. They are in the St. Petersburg, FL. area and likely homeless or seeking assistance from charities.”
 
Ms Oliveria said that on May 5, Jasai was placed back in the physical custody of his father. He had been removed from his mother’s custody after Florida police had raided a homeless shelter.
 
Yesterday [May 6] Jasai and Mr. Burrows were due to appear in a St. Petersburg court in order for the final legal steps to be taken. It is not completely clear if Ms Swan abducted him from the court area, or if Jasai, now 13, voluntarily left the care and custody of his father in order to return to his mother and half-sister.
 
Mr. Burrows is presently in Florida, and obviously this latest development was completely unexpected. However, he intends to keep up the fight for his son. Child abduction and brainwashing go hand in hand.  The abductors need to face severe consequences and this needs to be dealt with as the heinous crime that it is.   Here is a father who has sacrificed everything,(FOR 9 YEARS),   and even when justice was finally about to be served, the twisted reality his homeless mother had imposed on him prevented a reunion with a parent who cared enough to wage this kind of battle.

Their needs to be a forum for these older abducted children to finally be able to sort through their emotions, and truth and fiction.   A link to this one to read about the heartache, frustration, financial toll these parents go through to reunite with them.
