A família do brasileiro Ricardo Costa, acusado de molestar sexualmente os próprios filhos e preso há mais de dois anos sem julgamento no Estado do Arizona, diz que a Justiça americana demora para analisar o caso porque não existem provas contra ele, além dos diversos erros cometidos no decorrer do processo. "Todos que pegam o caso percebem que estão com um 'pepino' nas mãos", disse Cristina Costa, mãe de Ricardo, em entrevista concedida ao Terra por e-mail.
Segundo a família, Ricardo e a ex-mulher, Angela Denise Martin, se conheceram no Japão, no começo dos anos 90, quando trabalhavam como modelos fotográficos. Os dois chegavam a viver no Brasil, mas se casaram nos EUA em 1993. Eles viviam no Estado do Arizona e tiveram três filhos. As acusações contra Ricardo vieram à tona durante o processo de divórcio, quando os filhos teriam relatado episódios de abuso sexual cometidos pelo pai, segundo inquérito elaborado pela polícia. Ele foi preso durante uma das audiências de divórcio, no final de 2008, mas até hoje não foi julgado.
A defesa de Ricardo diz que o caso tem apresentado diversos problemas legais que atrasam o andamento do processo. O julgamento está marcado para agosto deste ano, mas o advogado Bruce Griffen, que representa o brasileiro nos EUA, acredita que pode haver mais demora. Um exemplo seria o recurso contra a fiança estipulada pela Justiça em US$ 75 milhões, a serem pagos em dinheiro apenas, o que pode demorar mais de um mês.

Terra: Como Ricardo está lidando com toda essa situação?
Cristina Costa: Muito confiante, forte mentalmente e sereno. Quer muito que o julgamento aconteça, pois sabe de sua inocência, sabe que não existe qualquer prova contra ele. Têm muitos moradores de Sedona (cidade onde o casal vivia) dispostos a testemunhar a seu favor. A angustia também é natural, afinal audiências, e o próprio julgamento, são frequentemente marcados, e por diversos motivos adiados, protelados, sempre pela acusação, nunca pela defesa.
Terra: Como era a relação do casal antes do divórcio?
Cristina Costa: O relacionamento com o tempo se desgastou, houve conflitos, discordâncias diversas que levaram à separação. Não houve agressões físicas, mas uma separação difícil que gerou um divórcio do tipo litigioso.
Terra: Como a família interpreta o que aconteceu, porque a ex-mulher fez essas acusações?
Cristina Costa: A ex-esposa, desde a separação, buscou inúmeras formas de prejudicá-lo e tem-se a evidência de "alienação parental" em relação ao pai, sempre tentando afastá-lo dos filhos. Os motivos para isso devem ser perguntados a ela. A família entende que (ela) não se conformou com a separação, sofre com o fato da idade ser mais avançada que a dele, e entende que há evidencias de um forte descontrole emocional.
Terra: A família de Ricardo tem contato com as crianças? Eles falam português e já vieram ao Brasil?
Cristina Costa: Não. Existe uma liminar conseguida pela ex-esposa que impede qualquer contato. Até 2007 falavam português de forma superficial (a ex-esposa não fala), mas certamente hoje não falam mais. Não vieram ao Brasil.
Terra: Por que vocês acham que a Justiça americana está demorando tanto para julgar o caso, acreditam que existe alguma conotação racial por ser brasileiro ou preconceito por ser acusado de crime sexual?
Cristina Costa: A tese da defesa (e da família) é que estão protelando e demorando para julgar o caso pois não existem provas e, principalmente, porque existe muita gente envolvida no caso que errou: o juiz que decretou a prisão pela simples acusação; o detetive que o algemou na corte sem tê-lo investigado (e que confirmou que fez isso numa audiência seguinte, quando ao ser questionado se havia investigado disse: "Não, não investiguei, eu o prendi porque quis") e os próprios promotores que já cuidaram do caso. Todos que "pegam" o caso percebem que estão com "um pepino nas mãos". Sabe-se que a lei prevê uma inversão de papeis radical: uma acusação desse tipo não comprovada (contra um réu inocente) gera uma subsequente apuração do acusado e de todos que tomaram as medidas punitivas. E, ao que parece, é por isso que tanto se demora.
Mas pode sim haver algum preconceito contra estrangeiro. Um exemplo: há um mês atrás, um rapaz americano acusado de abuso sexual e uso de drogas também foi detido. Ficou lá, na mesma detenção do Ricardo. Mas ficou por três meses. Foi estabelecida uma fiança de US$10 mil. O advogado dele negociou, ficou por US$5 mil, ele pagou a foi embora.
Terra: Como é a relação das crianças com o pai?
Cristina Costa: Sempre foi o Ricardo quem cuidou das crianças, desde o café da manhã, levar na escola, ir às festas, passeios, acampamentos etc. A ex-esposa não fazia nada, nem mesmo cozinhava, era ele também que fazia a comida. Depois da separação, houve claramente uma "alienação parental" pela mãe. As crianças foram afastadas do pai e, pelos relatos obtidos no processo, claramente sofreram coerção para temê-lo.
Terra: As crianças já o visitaram alguma vez na prisão?
Cristina Costa: Os filhos nunca o visitaram. Mas várias vezes Ricardo recebeu visita de amigos que levaram os filhos que eram amigos dos seus filhos dele. As visitas ocorrem às quartas-feiras e existe até mesmo um calendário de qual amigo irá visitá-lo.
Terra: Ricardo pretendia brigar pela guarda das crianças no processo de divórcio? Pretendia voltar ao Brasil com elas?
Cristina Costa: Ricardo nunca quis voltar ao Brasil, ele sabe que as crianças são americanas e entende que é lá que elas devem viver.
A família diz ainda ao final da entrevista que Ricardo não está pedindo para ser libertado porque é inocente, está pedindo apenas para ser julgado. "Está apenas pedindo: 'me julguem, eu quero o julgamento'. Ele sabe que será inocentado", diz a mãe.
"Ricardo diz a quem quiser: 'ande pelas ruas de Sedona e pergunte se conhecem Ricardo Costa. Depois perguntem se conhecem Angela Denise. Colham as respostas. Façam isso e tirem suas conclusões'", afirma Cristina. De acordo com a mãe, o filho acredita que é alvo de conspiração que envolve o ex-sogro, a ex-mulher, a psicóloga que acompanhou as crianças e os juízes do caso.
