I have been emailing with a US father whose child was taken to Brazil last year. He is afraid (for obviously good reasons) to go to Brazil for fear of being arrested due to unknown legal actions that may have been initiated against him. I suggested that he search the court records for his and his wife's name. He believes that legal actions may have been taken in Sao Paulo and/or Minas Gerais. He is willing to pay any associated fees for such a search.

If you live there and/or have contacts with someone who could conduct a search, please contact me by private message and I will supply you with the full names.

1) Download Release of information
http://www.state.gov/documents/organization/111755.pdf
* Add Congressman & Senators name to release.
* Add your Attorney-Emergency contact in case you have trouble in Brazil; to release.
**Unless whom every is on this release form-they wont be able to communicate w/Embassy or vis versa

2) Download Release of information form to your Senator and Congressman.
* Send Congressman/Senator Release of information with your W/Embassy contacts name.
* Send Congressman and Senator State Dept. Release of info.

3) Contact American Citizen AMC Service Chief in US Embassy.
*  Embassy/Consulate can reach into Foreign Courts (Brazil) and get you a heads up on any criminal or other
* Other- Embassy/Consulate can list out cases with you and your child, the info on the mother cannot be retrieved unless
   it includes your name and or child's name.
*You will get a brief description Case/Type - Date Started/Last action - Parties involved.

4) You can get a limited power of attorney in Brazil to retrieve the entire court case  for you.
* Some countries allow a "notary" to go to court and get documents on behalf of a person with a power to due so "POA".
* Embassies and Consulates have a list of attorneys, translators and notaries.
** Limited POA means nothing but-collecting court documents.
*Embassy/Consulate cant collect but can get you very brief summary.

5) Send email to Embassy/Consulate Chief of AMCwith Relase of info-Birth cert.- requesting information on the case.
* Cc your Congressman & Senator-Your attorney
*Explain why your requesting info, your suspicions and a brief  explanation of the facts.
** Date of abduction, how your child traveled-Passport numbers, ,
** Abductors name, potential Alia's, parents and family addresses, friends addresses.
** Embassy's have RSO's Regional Security Officers-FBI-DipSec-Military--Other
**Give them all the clues needed to look in further on your behalf..

It is possible to check the info online and for free, but without knowing for sure the name of the defendant and the court jurisdiction (area) where the lawsuit may have been file, the search will be very difficult and time-consuming. Another option is to pay a fee to an specialized office to search the courts' files on your behalf. But those offices usually cover limited jurisdictions, so you have to check in Sao Paulo and again in Minas Gerais.

Be careful with this Tim. Not everybody is as innocent as they may appear. If he did nothing wrong, he should hire a lawyer there and have the allegations challenged. If he's innocent of any wrongdoing and he has proof, it will come out. All I'm saying is to just be careful. I did this and found out the guy was a dirtbag.

These assholes have denied and delayed my reasonable requests so many times I can't even bring myself to ask them for anything anymore...

The frustration of dealing with my own government between the US Embassy and the Department of State is more than I can handle at this point.

The director of OCI has even recently sent me a couple emails saying he's available to "discuss" my case but I can't bring myself to get in touch with any of them anymore.

Every fruitless effort and entreaty to get them to just do their jobs comes at a personal cost in frustration and energy, and each new time brings with it the memory of every other time they have smugly, indifferently and incompetently stood by while Mexico mishandles every aspect of everything (like they always do.) 

I kept thinking, maybe, this time they will do... something, anything, but no.  Same shit.  Everyday.  For years. 

These people may work for the American government but they DO NOT support the American people... unless your grandfather is a US Congressman.

He doesn't need to go to Brazil at all...if his child is abducted, he needs to file the Hague and go through the process...Going down there without a legal process going on is pointless and reckless, for the simple fact that there may actually be charges on him...I'd tell him, to check, see what he can find online, whatever, but to fight the case from a distance, if he's legit, he'll do well in the matter...
