I do not understand why a Federal Court Judge would indicate mediation or a negotiated settlement. Why would they indicate a LBP negotiate with a kidnapper ahead of a decision to have their children returned according to the law. If children were routinely ordered returned, wouldn't that destroy the efficacy of mediation? Therefore, by routinely ordering returns a particular country would be impeding negotiation between partes. The only way mediation (or negotiated settlements) can be thoughtfully considered is when there is question whether a country's Federal Court system will follow the law or that the wheels of justice are so slow that your children will be half-raised when the do reach a final, just decision to return.

For that matter, why are the remedies civil ...

As I dont understand Spanish I cannot specifically comment on this particular case but pray all comes to a good ending soon.

Thats a little bit of the video.

The first case is about a judge, who has the custody of the children with her ex-husband.
The second case is about Dora's father, who has her custody. However, the mother have abudcted her. Now the father could find her after 5 years and Dora lives with him again. At present, the mother want to talk to the media, because the court has not yet given her permission to see the girl.
The third case. this case is complicated because the mother of the girl lived with a Bolivian in Brazil. The girl is not daughter of the this Bolivian and he knew. However, when they have separated, the woman decided to let the girl with him, because she didn't have conditions to support her daughter. Later she married again and wanted that the girl would live with her again. The Bolivian fled with the girl and nobody knows where he is living with the child!
