STJ formalizes conciliation on guard smaller Canadian, son of Brazilian

The Superior Court of Justice (STJ) formalized this Thursday (27), reconciliation between the parents of a child born in Canada, the son of a Brazilian mother and Canadian father, a share of search and seizure of the child, now seven years old. The mother brought her to Brazil, in 2004, without the consent of the father. A conciliation hearing held by Judge Paul called Furtado, Third Class, resulted in an interim agreement under which the lowest return to live in Canada with his mother, from March 2011 with all expenses paid by the father. Before that, however, will travel to spend the school holidays there.

Under the agreement, suspended the application under consideration in the STJ over the case. The Third Chamber of the Superior Court was responsible for considering special appeal filed by the mother, whose goal was to change the decision in the records of the action that had been filed by the Union The Union's objective was to deliver the lowest responsible authority in Canada, based on Convention on Civil Aspects of International Child Abduction (Decree 3.413/2000) - Hague Convention.

According to the judge, conciliation was signed "the best way to guarantee the welfare of the child" and thus the Hague Convention will be fulfilled. The judge explained also that the arrangement is temporary because the decision may be reviewed by the Canadian Justice when the mother returns there, which is unlikely to happen, since the parents have already entered into an agreement.

Custody of the child

The story surrounding the case was initiated when the boy's mother went to live there and maintained a relationship with a Canadian. After separation of the couple, the child lived with her mother, but not regulated spouses, before Justice Canada, issues concerning the custody of the child. Until, in 2004, the mother, possession of a permit from the father of the child to travel only to the United States, changed the route and flew to Brazil, where he has lived since.

In Brazil, the Union filed the complaint for search and seizure of the child - which was upheld. That's when the mother appealed to the Federal Regional Court of the 2nd Region, which confirmed the sentence, denying dismiss the appeal. Bitter, the mother filed a special appeal to the STJ.

So, what does this mean? That Francois won't get custody of Lucas until March 2011?

I wonder when school gets out in Brazil or are they already on break now? With the different seasons I'm not sure.

Am I understanding this? Lukas returns to Montreal full time next March and until then, he goes
to Canada on school holidays? What if in March she doesn't return to Montreal? Is this a final
decision or can she appeal again?

Help with understanding from the law experts. Perhaps the google translation makes it sound
a bit confusing.

I hope this means that François won!!!!!!!!!!!!!!!!! If so, when will we see "wheels up"?

Ok, I'm lost.. what does this mean?

I think Francois does get his son back and Lukas goes to visit his mom in Brazil on school breaks? If that's the case then it's a joint custody and it's fair.

I hope Francois is happy with what ever this decision means... I just hope he has been able to spend time with Lukas and has free access to him .

Ok, I just read this for the fifth time...

I think it means that Lucas can go visit his dad in Canada this summer and go back to Brazil in the fall. Then in March 2011 he permanently moves to Canada with his mom.

I think that's how it is..  :confused: :confused:

If I'm right, then this is a good ending..

Yeah - but this summer in Canada is winter in Brazil. Need help from a Brazilian to better understand the school year cycle in Brazil.

I'm honestly as confused as the rest of you. I'm hoping that Andre might sign on soon and help us better understand.

Why they would give the woman 9 months to get to Canada... Good Lord, she could be off to any corner of the world by then.

Since he's coming in March 2011, I would guess that with "vacation" they mean July of this year.

As this was a concilliatory hearing, it was unlikely that she would be ordered to hand over the kid immediately.

I am always pessimistic regarding to the Brazilian justice, so anything else than "the kid stays with the mother, you're on your own" is better than the expected, in my opinion. But then again, I'm not the one suffering...

I thought it was interesting that they called it an interim agreement I guess because the judge expects that Canadian courts might review the decision at some point.

Sounds like he did this so that Lucas will have a transition period before moving back to Canada for good.

Brazilian school breaks happen in July (winter, which means nothing in Brazil), and from mid-December to the beginning of February (summer).

From what I can tell it says this (native Portuguese speakers please help):

The boy will be returned permanently in March of 2011 and live with the mother. Until that time he will visit Canada on school breaks: I'm guessing that means he will be home (Canada) for months around Christmas 2010.

It also indicated that this agreement may be reviewed by Canadian Family courts upon the mother's return in March 2011.

Ok, thanks ultranol. After fighting this for such a long time I hope this agreement provides some relief for Francois and that his ex actually complies.

Ok, so school year calendar had nothing to do with it -- if it did, they would not have scheduled the move for March.

I think it's a fair decision that Lukas will have access to both his parents. I hope Francois is at peace with the decision and has been able to spend the time this week with Lukas and start to bond.

My only concern is similar to M. Capestro's .. Will the Mom actually comply with the court decision and bring home Lukas in March 2011.. or will she be in another corner of the world??
