Is this right? Isn't it supposed to be decided in the US?

I think it is just a confusing sentence.  I think it is trying to say that both countries agree that it is ultimately up to the Brazilian courts to decide as to whether the U.S. courts should have jurisdiction with respect the custody dispute.

It also states that "being settled" is an exception to the Hague Treaty, which is false.  However, I recommend that we do NOT flood this guy with emails demanding a correction until we hear from Mark.  Let's do this with one voice first.

Yes, according to the treaty Sean should have been returned to "the place of his habitual residence," the US, within six weeks of the filing of the Hague claim. We now know that Bruna submitted the required standard travel document for a child as some kind of proof that she had custody and committed perjury before a Rio state court judge claiming that she and David were separating.

Amazingly she did that without the advice of legal counsel, and figured it out all her own ........ I'll believe that when I see pigs fly.

Good article.  I found the following interesting:  
 
"There appears to be little conflict between the two governments over how the case should be resolved.
 
Both governments have indicated that they consider the decision by Goldman's wife, Bruna Bianchi, to move Sean to Brazil in 2004 a violation of the Hague Abduction Convention, an international treaty that seeks to determine whether children have been wrongfully removed from their country of habitual residence.
 
The State Department has characterized Brazil as having a "pattern" of "noncompliance" on the treaty, she said."    Isn't that the truth!!!!

Great to see that visibility is increasing... some of the legal aspects are confusing to us "regular" folks. BUT - it is really helpful to get the word out more and more. The more people see and learn about all David has endured, the more support we can see coming David's way.

The front page?  Awesome news!  Glad to hear that the BSH team will be contacting the reporter to clarify some of the legal points.  Other than that, it's a good article.  Glad to see the major US newspapers are FINALLY reporting on this story!

I just emailed the writer pointing out the major error he made stating that both the US and Brazil agree that custody has to be decided in Brazil.

Then I clicked on a link to his name and discovered he is based in Rio!

Anyway even with that error it is Excellent it made the front page, just the day before Lula visits Barack. :hihi:
