Hi everyone !

I've been following David's case for 2+ years and I'm very happy that he's got his son back.  Today we all can say that without BSH I don't think he would have succeed.  

My son was abducted from Canada to Brazil (Rio de Janeiro) in October 2004.  It took 2 1/2 years before the trial.  I went to Court in Rio in February 2007 for a 2 day hearing (me, mother of my son, witnesses, respective lawyers, etc).  On March 19, 2007 the judge ordered the return of my son to Canada.... Mother appeals...

On October 18th, 2007 Court of Appeal (Tribunal Regional Federal da 2a Regiao) confirmed the decision (3-0 judges in my favor).

Child is hidden by the mother and in November she gets a suspension of the enforcement order pending her appeal of the Appeal decision.  Granted by Justice Fernando Marques, Vice-President of the Tribunal Regional Federal da 2a Reggio.

For 2 years now waiting for my case to be heard at STJ (Superior Tribunal de Justicia).

I've never wanted to go public but I think it's the only way I could get my son back.

If some of you want to help my strategy would start by sending emails to Canada's Prime Minister and Minister of Foreign Affairs explaining what we all know and why Canada must pressure Brazil to apply the Hague Convention in a proper way.

I'm sorry to hear about your abducted son.  

Have you tried seeking the help of your MP?  Those people are usually very helpful to their constituents.  Then, start getting the word out into the Canadian media.

I think you still do not want to go public.It is the only way.BSH is mainly US citizens who were able to bring this to publics attention.Cong Smith made a major difference.I do not see how I can help in Canada.You should be pestering Montreal Gazette/LeDevoir.Contact Quebec politicos--Pauline Marois(she needs a new cause).You should strike while Davids case is in the news.People are interested.It is up to you.

YES we can help from the U.S.!!!!!!!!!
 
We can still call. We have Canadian members. We can raise awareness. We can contact Candian media. Just because this case is not a U.S. case does NOT mean we at BSH cannot help. We can even urge Congressman Smith to share info and join forces w/ politicians iin Canada.........

Lastly - David, there are many prayers across the world going out for you and Sean. When I got my son home - regardless of all the attempts of parental alienation that were forced on him - he said "Father, I always knew you loved me." I am certain Sean feels the same way.

I just think that if Canada would join USA it would surely put more pressure on Brazil to respect the Hague Convention and apply it correctly... It's not normal that it takes 5 years to return a child and that is causing psychological damages to children.

It makes me ill to think you've been put through the same "waiting" with the courts in Brazil. I'm hoping for you that somehow very soon you'll be able to bump your case up in the very slow world of the Brazilian courts.

I think this is a great point to make....The more countries that join together and start pressuring for compliance w/ the Hague, the better..........
 
And now since Francois let the cat out of the bag, let me clue you into why this is a good place for us to focus and help.......
 
This thread was started by Francois Larivee. MANY of you have heard his story and we have mentioned his case on this board many times. He has monitored this board thru the months but is only now going public. His son was kidnapped to Brazil. Want to hear the kicker???? JPLS and PLS were HIS ATTORNEYS until JAN. 2009!!!!!!!!!!!!!!!!!!!!!!!!!!!! Talk about conflict of interest!!!!!! I'll let him tell you why he fired them if he wants to.............:cool:
 
Anyway, he has gone HIGHER UP the courts than even Dave did and won. And still, his son remains in Brazil. He should get his son IMMEDIATELY based on Brazil's new understanding of the Hague, and yet he has not. THIS SHOULD BE the case that we can see results the fastest IMO...........This is a SLAM DUNK!!!
 
Furthermore, we have seen 1 Hague return from Brazil w/ Sean. BUT, we need it to become the "norm", as opposed to the exception. The Larivee case does not have the media attention or the "deceased wife" situation so if we can get another return w/out as drastic a circumstances, then we pave the way for many more returns. We don't want the dramatic circumstances surrounding the Goldman case to be the reason for returns. We want it to be because of the rule of law.
 
We have many new goals here now. I saw where Marty ( NicolesDAD ) is going public in a big way. Paul Toland and Patrick Braden have been public. There are so many that need our support. And this is another cause that we need to support any way we can. This man has waited way to long like many others. This is a fight we should and can win. It's a no brainer IMO. Having 2 Hague returns in a short span with different sets of circumstances can only be good.
 
Support Francois Larivee and all of the others and don't restrict yourself to thinking "I don't live in Canada so I can't help".......k? ;)
 
PS- Francois does not want to mention his son's name at his point but will consult w/ an attorney about the matter. Until then, when calling or emailing just reference Francois Larivee and his son.........

That's our hook right there to piggyback on the media coverage that David's case is getting. If we continue to push that in the US media first it will probably generate media attention here (perhaps with some nudging from us).
 
While it has definitely been helpful that we've been getting media coverage overall, I've been less than thrilled that they haven't picked up that angle despite it being pointed out to them, however I was also thinking they probably need it substantiated so this would be perfect.
 
BTW, I won't contact media until I know Francois is ok with it and wants to do interviews etc.

I have been an avid supporter of David and Sean and I'm Canadian!  Didn't stop me from calling the Whitehouse line, e-mailing SOS Clinton, e-mailing the DOS, and writing to every news agency both in the U.S. and Brazil.  Doesn't matter where you live, you can help in this fight.

On August 4th, 2009 I sent an email to Mr. Lawrence Cannon (Minister of Foreign Affairs) explaining my situation and asking help form the canadian government given the fact that I had been waiting for 2 years for my case to be heard at STJ (Supremo Tribunal Federal)....

I got an answer on November 30th, 2009 from a Secratary of Foreign Affairs explaining that they are behind me, etc,etc,... and at the end they refer me to Mrs. Nancy Coulombe (Ministry of Foreign Affairs).  This women is very nice and she knows my case since the beginning but there is nothing she can do more...

Given that fact that I already have 2 judgments in my favor oredering the return of my son in Canada and that nothing is moving on with my case in Brazil I need canadian politicians to show up and help me and pressure Brazil.

Here is a list a key politicians that I would like to focus on :
