sure is quiet in here....

am I the ONLY person who has no life once their kids are in bed?? lol!
History has demonstrated that the most notable winners usually encountered heartbreaking obstacles before they triumphed. They won because they refused to become discouraged by their defeats.

I think we're each working on different things, just not necessarily things on the forum. I just made contact with three new fathers with cases to Brazil and I've been trying to get a definitive answer from Interpol about why Sean wasn't detained when he visited Argentina and France.

I would like to know how he was able to leave the country as well.  Maybe they give them fake passports?  Or one in a different name?  Can this be tracked and if so what can be done about it?

It might take a while because Interpol refuses to speak to private citizens. I need to wait for others I contacted with whom they will speak to get back to me. Every left-behind father I speak to has a different understanding of this question.

I just spoke to the director of the Office of Children Issues. She indicated that Sean was not detained because David had never filed criminal charges against Bruna. It is a "damned if you do, damned if you don't" situation in that I was advised that filing criminal charges severely weakens your Hague claim. I know in my hearing, I needed to repeatedly reassure the judge that I had not and did not plan on filing criminal charges against my wife.

K..I am really not understanding the Hague then.  Isn't the Hague invoked when a child is parentally abducted and removed to another country ILLEGALLY thereby labelling that person a child abductor?  And isn't child abduction a crimanal offense punishable by law?  Even if you didn't file criminal charges, isn't that automatic once the Hague is invoked by the left-behind parent?! This makes absolutely NO sense!!   It's indicating that child abductors can simply go on and live their lives.  It's not right!

Wendy, I agree with you. I cannot make sense of it either. If Interpol won't stop child abductors, then why have others mentioned that is one of the first things someone who had his/her child abducted to do after filing applicable documents for the Hague Treaty? Is it selective depending on the country for the abductor and child to be detained??

Welcome to our world. I have tried to understand the answer to these questions and many more and am still confused. When I was speaking to Ms. Furuta-Toy, I asked her whether it was strategically preferable to push for criminal charges as Mr. Pate and others have done or to not push for charges as David and I have done. Whether such charges are automatic is also up for debate. Her response was that since Brazil has sent back so few children, it is not possible to reach any conclusions.

At least I think I made progress in my efforts to reach out to the other 40+ left-behind parents I haven't yet spoken to. If I'm right, be on the lookout for many more abduction cases to be posted.

Well, I'm glad to hear that my lack of understanding is not from ignorance :-) I am also pleased to hear you were able to make progress in adding other left behind parents plights to the website. As tragic as your and all of their stories are, hopefully the profile of these cases will be raised and they can be properly addressed in the Brazilian court system.
